TERMS & CONDITIONS

1. General

These Terms & Conditions apply to the use of the website www.studiomassoro.com (the “Website”) and to all offers, orders and agreements between MASSORO and consumers.

MASSORO is hereinafter referred to as “MASSORO”, “we”, “us” or “our”.

The consumer is hereinafter referred to as the “Customer”, “you” or “your”.

These Terms & Conditions apply exclusively to agreements with consumers acting for purposes outside their trade, business or professional activities.

By placing an order through the Website, the Customer confirms that they have read and accepted these Terms & Conditions.

These Terms & Conditions are available on the Website before an order is placed and may be saved by the Customer.

2. Products and Offers

MASSORO offers jewelry and related products through the Website.

For each product, we provide information as clearly and accurately as reasonably possible, including:

  • the product name;

  • the main characteristics of the product;

  • the materials and/or composition;

  • available colors and variations;

  • dimensions, where applicable;

  • the purchase price;

  • any additional costs;

  • available payment methods;

  • the expected delivery time.

MASSORO makes every reasonable effort to ensure that product descriptions, images, colors and prices are displayed as accurately as possible. Minor differences in color may occur due to the settings of the Customer’s screen or device.

Obvious errors or mistakes in an offer are not binding on MASSORO where it is reasonably clear to the Customer that an error has occurred.

3. Prices

All consumer prices displayed on the Website are stated in euros and include VAT, where applicable.

Any applicable shipping costs will be clearly displayed before the Customer completes the order.

The total price of the order will be shown to the Customer before payment.

MASSORO reserves the right to change prices and promotional offers. A price change will not affect an order that has already been validly placed and confirmed.

For discounts and price reductions, MASSORO complies with applicable legal requirements regarding price displays and promotional communications.

4. Placing an Order

An order can be placed as follows:

  1. The Customer selects a Product;

  2. The Customer selects the desired variation, color or size, where applicable;

  3. The Customer adds the Product to the shopping cart;

  4. The Customer reviews the order;

  5. The Customer enters the required information;

  6. The Customer selects an available payment method;

  7. The Customer reviews the order and total price;

  8. The Customer places the order by clicking the designated order button;

  9. MASSORO confirms receipt of the order by email.

The order button clearly indicates that placing the order creates a payment obligation for the Customer.

An automatic order confirmation confirms that MASSORO has received the order. The agreement is concluded when MASSORO confirms the order, unless MASSORO is unable to accept the order.

MASSORO reserves the right to refuse an order or request additional information where there is a reasonable basis to do so, for example in the event of an obvious pricing error, suspected fraud or if a Product unexpectedly becomes unavailable.

If an order is not accepted, the Customer will be informed as soon as reasonably possible and any amount already paid will be refunded in full.

5. Payment

The Customer may pay using the payment methods made available on the Website.

Payment must be completed in full before the order is processed, unless MASSORO expressly states otherwise.

If a payment fails, MASSORO may suspend processing of the order until successful payment has been received.

6. Shipping and Delivery

MASSORO generally processes orders within 1 to 5 business days, unless a different timeframe is stated on the Website for the relevant Product.

Orders are shipped to the address provided by the Customer.

The Customer is responsible for providing accurate and complete delivery information.

If an order cannot be delivered due to an incorrect address provided by the Customer, MASSORO will, where possible, contact the Customer to find a suitable solution.

MASSORO makes every reasonable effort to deliver orders within the stated timeframe. If an order cannot be delivered on time, the Customer will be informed as soon as reasonably possible.

If a statutory or agreed delivery period is exceeded, the Customer retains all rights available under applicable law.

The risk of loss or damage to a Product passes to the Customer only once the Product has been received by the Customer or by a third party designated by the Customer who is not the carrier.

7. International Orders

For shipments outside the European Union, additional import duties, taxes, customs charges or other fees may apply.

Where such costs are payable by the Customer, this will be communicated as clearly as reasonably possible before the order is placed.

MASSORO has no control over the amount or method of collection of local taxes, import duties or customs charges.

The Customer is responsible for complying with applicable local import and customs regulations.

8. Right of Withdrawal

8.1 Statutory Withdrawal Period

For online purchases, the Customer generally has the right to withdraw from the agreement within 14 days without giving any reason.

The 14-day withdrawal period begins on the day after the Customer, or a third party designated by the Customer who is not the carrier, receives the Product.

If multiple Products in the same order are delivered separately, the withdrawal period begins on the day after the final Product has been received.

8.2 Exercising the Right of Withdrawal

The Customer may exercise their right of withdrawal by sending MASSORO a clear statement within the withdrawal period indicating their decision to withdraw from the agreement.

The Customer may use the model withdrawal form provided by MASSORO, but this is not mandatory.

Withdrawal may be communicated by email or through MASSORO’s designated return process.

8.3 Returning Products

After notifying MASSORO of the withdrawal, the Customer must return the Product no later than 14 days after the day on which the withdrawal was communicated.

The Product should be packaged carefully and, where reasonably possible, returned in its original packaging.

The Customer may inspect and try the Product to the extent necessary to establish its nature, characteristics and functioning.

The Customer may be liable for any diminished value resulting from handling beyond what is necessary to assess the Product.

8.4 Return Costs

The cost of returning a Product is the responsibility of the Customer, unless MASSORO states otherwise or applicable law requires MASSORO to bear these costs.

8.5 Refunds

Following a valid withdrawal, MASSORO will refund all payments received from the Customer, including the cost of the original standard delivery.

MASSORO may withhold the refund until the Product has been received or until the Customer provides proof that the Product has been returned, whichever occurs first.

MASSORO will use the same payment method for the refund as was used for the original transaction, unless the Customer expressly agrees to another method.

If the Customer selected a more expensive delivery method than the least expensive standard delivery option, MASSORO is not required to refund the additional cost.

9. MASSORO Extended Return Period

In addition to the statutory 14-day right of withdrawal, MASSORO voluntarily offers customers an extended return period of up to 60 days after receiving the Product.

This extended return option is subject to the conditions stated by MASSORO on the Website.

The statutory 14-day right of withdrawal remains fully applicable and is not restricted by this additional return option.

Products purchased during a promotional sale cannot be excluded from the statutory right of withdrawal solely because they were purchased at a reduced price.

10. Exceptions to the Right of Withdrawal

The statutory right of withdrawal does not apply in every situation.

If a statutory exception to the right of withdrawal applies to a particular Product, this will be clearly communicated to the Customer before the order is placed.

A Product is not excluded from the statutory right of withdrawal solely because it is jewelry.

11. Statutory Warranty and Conformity

The Customer is entitled to a Product that conforms to the agreement.

This means, among other things, that the Product must have the characteristics that the Customer may reasonably expect based on the agreement, the product information and the nature of the Product.

The statutory warranty is not limited to a fixed period of 60 days.

If a Product does not conform to the agreement, the Customer may contact MASSORO. MASSORO will assess the complaint and, where the issue is a defect for which MASSORO is responsible, provide an appropriate remedy as required by law.

Depending on the circumstances, this may include:

  • repair;

  • replacement;

  • refund;

  • price reduction;

  • or another remedy permitted by applicable law.

The Customer’s statutory rights are not limited by any commercial warranty offered by MASSORO.

12. Damage and Normal Use

Jewelry may naturally show signs of wear over time. Damage resulting from normal wear and tear, improper use, careless handling, accidents or failure to follow care and maintenance instructions is not automatically covered by the statutory warranty.

This does not affect any statutory rights the Customer may have.

When a Customer reports a Product as defective or damaged, MASSORO may request photographs and a description of the issue in order to assess the situation.

13. Complaints

Complaints may be submitted via:

Email: info@studiomassoro.com

MASSORO aims to handle complaints as quickly as reasonably possible.

The Customer will receive a substantive response within 14 days of receipt of the complaint or, if more time is required, a notification explaining when a substantive response can be expected.

Submitting a complaint does not affect any statutory rights available to the Customer.

14. Liability

MASSORO is not liable for damage to the extent that such liability cannot be excluded or limited under mandatory applicable law.

MASSORO is in any event not liable for damage resulting from:

  • incorrect or careless use of a Product;

  • use contrary to the provided care or maintenance instructions;

  • normal wear and tear;

  • circumstances that are reasonably beyond MASSORO’s control.

Nothing in these Terms & Conditions limits the statutory rights of consumers or MASSORO’s liability to the extent that such liability cannot legally be excluded or limited.

15. Force Majeure

MASSORO is not required to fulfil an obligation where it is prevented from doing so by circumstances that cannot reasonably be attributed to MASSORO.

Force majeure may include, where relevant:

  • natural disasters;

  • fire;

  • war or threat of war;

  • government measures;

  • strikes;

  • transportation disruptions;

  • supplier disruptions;

  • internet or communication system failures;

  • serious operational disruptions;

  • and other circumstances reasonably beyond MASSORO’s control.

If a force majeure situation continues for longer than can reasonably be expected, MASSORO and the Customer will consult with each other regarding an appropriate solution.

The Customer’s statutory rights remain unaffected.

16. Intellectual Property Rights

All intellectual property rights relating to the Website and its content, including texts, images, logos, designs, photographs, videos, trade names and other materials, belong to MASSORO or its licensors, unless stated otherwise.

Without prior written permission from MASSORO, it is not permitted to copy, distribute, publish, reproduce or commercially use material from the Website.

The MASSORO name, logo and any other distinctive marks may not be used without permission.

17. Use of the Website

The Customer may use the Website only for lawful purposes.

It is not permitted to:

  • use the Website for fraudulent or unlawful activities;

  • intentionally disrupt the Website;

  • gain unauthorized access to systems or data;

  • use automated systems to scrape or place an unreasonable load on the Website;

  • use the Website or its content for commercial purposes without permission.

MASSORO makes reasonable efforts to keep the Website available, secure and up to date. However, MASSORO cannot guarantee that the Website will always be available without interruptions, errors or technical issues.

18. Account

If the Customer creates an account, the Customer is responsible for keeping their login credentials confidential.

The Customer is responsible for activities carried out through their account, unless the circumstances cannot reasonably be attributed to the Customer.

The Customer must notify MASSORO as soon as possible if they suspect that their login credentials are being used by an unauthorized third party.

19. Privacy

MASSORO processes personal data in accordance with its Privacy Policy.

The Privacy Policy is available on the Website.

20. Changes to These Terms & Conditions

MASSORO may amend these Terms & Conditions when necessary, for example due to changes in legislation, business operations or services.

The amended terms will apply to new agreements from the moment they are made available on the Website, unless applicable law provides otherwise.

For agreements already concluded, the Terms & Conditions applicable at the time the agreement was entered into will continue to apply, unless mandatory law provides otherwise.

21. Governing Law

Agreements between MASSORO and the Customer are governed by Dutch law.

If the Customer resides in another country within the European Union, the mandatory consumer protection provisions of the country in which the Customer has their habitual residence remain applicable to the extent required by law.

22. Disputes

MASSORO will first attempt to resolve complaints and disputes directly with the Customer.

If a dispute cannot be resolved amicably, the Customer may use the legal remedies available to them.

The Customer may bring a dispute before the competent court in accordance with applicable law.
